Avioehto

Avioehto voidaan tehdä, kun kihlakumppanit päättävät mennä vihille, rekisteröidä parisuhteensa tai jopa jo avioliitossa ollessa. Avioehto astuu voimaan rekisteröimällä se Digi- ja Väestötietovirastossa. Avioehtoja on erilaisia; muun muassa kokonaan molempien puolisoiden avio-oikeuden poissulkeva, toisen avio-oikeuden poissulkeva tai esimerkiksi myöhemmin perittävän omaisuuden poissulkeva. Avio-oikeus voidaan myös poistaa ainoastaan avioeron varalta. Erityisesti silloin, kun toisella puolisoista on enemmän omaisuutta, avioehdon tekeminen on harkitsemisen arvoinen asia.

Avioehtosopimus on asiakirja, joka on laadittava määrämuodossa. Asiakirjan allekirjoitukset on kahden todistajan todistettava. Avioliiton kestäessä avioehto ei vaikuta millään tavoin puolisoiden keskinäisiin omistussuhteisiin, eikä muihinkaan puolisoiden raha-asioihin. Avioehto astuu voimaa vasta sitten, kun puolisoiden avioliitto päättyy. Avioliitto päättyy joko toisen puolison kuolemaan, tai avioeroon.

Mikäli puolisot haluavat myöhemmin muuttaa tai purkaa tekemänsä avioehdon, onnistuu se puolisoiden tekemällä uudella avioehdolla, joka pitää myös rekisteröidä.

Avioehtosopimuksen tekemistä kannattaa harkinta myös silloin jos toinen puolisoista saa avioliiton aikana omaisuutta toista puolisoa enemmän tai esimerkiksi mikäli halutaan määrätä mitä lakia sovelletaan kansainvälisessä avioliitossa.
